Comparing genealogical records to determine how they fit into your ancestor's timeline can be tedious. For example, the mere mention of your ancestor as a witness to a deed may seem trivial. However, it does established his residence in that county for that date. Another vague source is tax digests which are not alphabetical (listed by districts) and difficult to read. But the devil is in the detail. The tax records lists specific lands. Example 202-1/2 acres. That denomination came from a land lottery. So the next step is to search the land lotteries from 1805 to 1832 in Georgia. Almost everybody drew in a land lottery at one time or the other. old roadOld roads. 

It was free land, so why not? Whether or not they ever took it up is another question. That is where the deed records come in and such new information should send you forthwith to a search of that county's deeds. Also on the Tax Digests are other tracts of lands, names of waterways, names of adjoining neighbors, and (always) the county where the land was located. But wait, we are not finished. At the end of each district is a list of "defaulters". These are persons who did not pay their tax for that year. That could mean that the person died or left the county. Only the deed records in all of the counties where he owned land will provide further data. Remember, during the Indian removals, people were moving on. By Jeannette Holland Austin

Oldest Courthouse in KentuckyPictured is the oldest court house in Kentucky in Greensburg. Green County was formed in 1792 from portions of Lincoln and Nelson counties and was named after General Nathaniel Greene, the famous hero of the southern campaigns during the Revolutionary War. Three courthouses have served Green County. In 1804, a brick building replaced an earlier structure, and while no longer operational, it stands in the Greensburg Historic District (downtown) and is the oldest court house building in Kentucky. The county seat is Greensburg, Kentucky.

There is an inclination today to accept other research and link it to your pedigree charts. There are a number of sites which provide easy linking to genealogies already traced. It is best not to link your ancestor to any genealogy charts on any website. Although at first glance this appears to be an easy way to have the lineage traced back further in time, it is a serious mistake. You do not want this unless you want a whole bunch of new problems to unravel. Here is how it works. A computer generation generally accepts all of the entries, even if it is for the same name. For example, you add Mary Smith born 1802. However, there is another Mary Smith born 1801. The computer treats it as two separate people. If you wish to use the research progress of someone else, I suggest that you check out their sources and double check the information in the records. Excellent sources include is old bible records, church and parish registers, and all information discovered at the county court house, viz: last wills and testaments, probate, estates of every sort, marriages, deeds, civil and superior court cases, land grants, pensions, and so forth. Such records represent sources of factual truths. One must gather all probable information and make comparisons with the data. Census records contain important data, such as places of birth, number of years married, proper names of children, and so forth. After speaking to relatives and gathering tombstone information, the census record is one of the first places to search. What I am saying here is that computer-generated charts actually raise the level of errors. Many people, in the interest of furthering their tree, accept the work of other people. I do not. However, I use that information as a guideline to establish actual facts. Research in county records is very important because few errors are found there. As a point of information, a last will and testament is usually filed of record and probated within 3 days of the death. The reason is that the relatives need to put the probate in process in order to have the authority to act for the deceased person. If you want to know where your ancestor came from or where he went, you must search all of the deed records as a matter of course. This is part of discovery. As for marriages, parsons were not always required to file their licenses and marriage ceremonies with the county court house. Therefore, until laws established this process (usually after 1900), few marriage records (per population) exist. Hence, one must search old newspapers where marriages and obituaries are found. This is a very tedious process. Also, it is easy to discover whether or not your ancestor had a last will and testament or estate on Kentucky Pioneers Simply click on a county on the homepage, and you will see a list of records available (to members) as well as names. This part is free. All that you do is click on the county and find out! It is very difficult to read the old indexes. We have made this very easy for you. All indexes are (typed) links to the actual documents in the court houses. Can it get any better than that? 

Fayette County Probate Records

Fayette County was one of the original three counties created from the former Kentucky County, Virginia by the Virginia Act in 1780, along with Jefferson and Lincoln counties. Together they separated from Virginia in 1792 to become the state of Kentucky. Originally, Fayette County included land which makes up 37 present-day counties and portions of 7 others. It was reduced to its present boundaries in 1799. The county is named after Marquis de LaFayette who came to America to join the rebelling English colonies in the American Revolutionary War. On January 1, 1974, Fayette County merged its government with that of its county seat of Lexington, creating a consolidated city-county governed by the Lexington-Fayette Urban County Government.

Not everyone files a Last Will and Testament to be probated in the county court, however, most families had an administrator appointed for any number of practical reasons. For one thing, they needed the authority to gain access to funds and sell property. For this reason we must systematically research all the court house papers such as Annual Returns, Inventories, Distributions, Sales, Vouchers and the Minute Books of Inferior Court. Because this is so important in locating relatives, whenever possible, I am adding the indexes to Annual Returns and estates for the various counties to GeorgiaPioneers.com. The first Annual Return for the estate generally pays doctor bills, funerals and miscellaneous expenses of the administrator. Thereafter, in later returns, funds are dispersed to the heirs. You should really review these returns carefully and attempt to identify everyone receiving payment. Receipts are given to administrator. You want to read the vouchers and receipts because this is where you will find the husbands of the daughters. Married women did not directly inherit; their husbands received the goods and signed for them. The Inventories and Sales contain the names of relatives and neighbors who were purchasing items. Also, this is where you will find a general description of parcels of land owned by the decedent and a list of notes owed him.

OwensboroOwensboroOwensboroDaviess County was formed from part of Ohio County in 1815 and was named for Abraham Owen, a Colonel who was killed at the Battle of Tippecanoe. The borders of the county were altered in 1829 to form Hancock County in order to absorb a small area surrounding Whitesville, and again in 1854 to cede land to McLean County. Then, in 1860 it annexed forty-four square miles from Henderson County. The county seat is Owensboro.

Apparently there was a loss of records from about 1815 to 1842 when certain last wills and testaments were destroyed. Those listed below were recovered.

The New Technology is Really for Genealogy

Did you know that it is far easier to read images of all documents on your computer sceen than from microfilm? This is because the microfilm reader is using its limited technological capacity. Many of these old readers have seen their day! However, when a record is digitized for the computer, all of the latest imaging software is operative. For example, Adobe has improved over the years. The reader may now zoom in or out by using the plus or minor signs at the bottom of the screen. So much better than the old days of using a magnifying glass. microfilmEven faded and aged images are better interpreted on the computer. The Georgia State Archives where you can read old county documents yet remains open to the public only two days per week. A very stressed situation, I must say. But good news! Georgia Pioneers has digitized hundreds of thousands of the old wills and they are available on the website.

Newport, KentuckyCampbell County was formed on December 17, 1794 two years after the creation of the Commonwealth of Kentucky. It was taken from sections of Scott, Harrison, and Mason Counties and was named for Colonel John Campbell (1735 to 1799), a Revolutionary War soldier and Kentucky Legislator. The original county included all of present Boone, Kenton, Pendleton, and most of Bracken and Grant counties. The county seat of Wilmington survived from 1794 to 1797 and its court house was built of logs, later replaced in 1815 by a brick structure. Newport was the county seat until 1823 when it was removed to Visalia. This site was unpopular and the county seat was returned to Newport in 1824, lasting until 1840. In 1840, Kenton County was created, primarily out of a significant portion of Campbell. The Kentucky General Assembly then forced the county to move its seat to Alexandria, closer to the center of the new, smaller Campbell County. In 1883, after years of lobbying, the General Assembly established a special provision to allow Newport to designate a Court House District separate from the offices in Alexandria.

You Need an Eye to Detail

A number of clues exist in public records which help the genealogist to locate lost relatives. One ancestor which I had researched for many years was discovered by reading Revolutionary War Pensions for that surname. It was Joseph Lane, resident of Missouri whose application stated that he had two sons who'd left home years ago, one who went west and the other to either Kentucky or Georgia. Although no given names were provided, my detailed notes provided two brothers in Georgia fitting that description. From there, I studied their estate records, viz, inventories, sales, annual returns and vouchers to see who was listed and where they resided. The names given in these types of records bear close relationships to the deceased. I found one lost ancestor by searching Jasper County annual returns (for everyone with that surname) and discovered that a trip to Kentucky was an item paid for and listed in the annual returns. This linked "the origin" of the family. Other great digs are deed records where heirs sell their inheritance and name other heirs in the deed. Every single record of that surname must be researched for little clues. 

Bullitt County Probate Records

Bullitt's LickBullitt County was founded in 1796 and the county seat is Shepherdsville. It was named after the nephew of Thomas Bullitt, Governor Alexander Scott Bullitt, who served as the first Lieutenant Governor. The land was taken from Jefferson and Nelson counties through an act approved on December 13, 1796 by the Kentucky General Assembly. In 1811, the northwestern area of the county expanded to include land given by Jefferson County and in 1824 an eastern area of the county was given to help form Spencer County.

Annual Returns are Part of Every Estate

Even if a person dies intestate, you can still find the heirs. This is done by examining the annual returns for every year until the estate is closed. The first thing which happens is that an administrator is appointed who makes an inventory of the estate, has a sale to sell off the items and subsequently files a return every year thereafter to the probate county in the county which the person died. This return lists all disbursements ranging from funeral expenses to distributions to the heirs which may occur at any time over the period the estate is active. The heirs then give receipts, called vouchers. Examine the expenditures closely. Try to ascertain the identity of the payees. One easy method is a study o f the census records for that county. Some of the heirs are husbands of daughters, so check out these names in the marriage records. 

Breckinridge County Wills, Estates, Deeds

BreckinridgeBreckinridge County was established in 1799 from a portion of Hardin County. When Abraham Lincoln was seven years old, his father, Thomas Lincoln and his family spent a few weeks in Hardinsburg and occupied a small cabin near what is now the Kentucky FFA Leadership Training Camp. The Lincolns left Kentucky by crossing the Ohio River at Cloverport on a log ferry operated by Jacob Weatherholt. The Confederate Army burned the local court being used by Union troops as barracks during the War Between the States. The third court house was burned in 1958. The county is known for its Victoria Coal Mines, named after Queen Victoria, when the Cloverport exported coal oil used to light Buckingham Palace.

Tax Defaulters are Important Genealogy Resources

All tax digests lists persons who have defaulted on their taxes, usually enumerated as the last page of each district. The tax digests are not alphabetical, so we have to thumb through all of the pages to find anything. The default list does not necessarily reflect persons who refused to pay their property taxes. Rather, from the point of view of the genealogist it lends itself more as a report of those who have either died or removed to another county. If the date is close to a mortality census (every 10 years), you can look there. Otherwise, if the person is old enough to have died, then searching the local cemeteries in the area is indicated. People were on the go and we have to be detectives.

Even before the Cherokee, Chickasaw, Shawnee and Yuchi were removed from Kentucky, there were European settlers. Counties were not formed until after the American Revolutionary War. Thus, in wilderness regions, the genealogist must really dig to locate old colonial forts and militia records. My personal procedure is to read every page of the tax digest in the county where my ancestor resided, recording the description of acreage, number of acres, names of neighbors, waterways, district, etc. (whatever the tax digest provides) for each year, then trace that same acreage forward. This information provides a time-line for when he resided in the county. When his name no longer appears, I search the default list. A sensible place to search next is the adjoining counties because the old parent county lines changed with the ascent of the formation of new counties and even States. For example, Hampton County Virginia went to West Virginia. The boundary lines frequently changed. Next, I look at marriages with that surname. This also gives me a time-line of the marriages of the sons and daughters as well as an idea of whether or not any members of the family were still around. If there was a ten or twenty year gap, say, that means that the older generation has either died or moved away. Of course, a thorough search of the deed records tells a better story, but there may be little or nothing there.

Burlington Boone County was founded in 1798 and named after Daniel Boone. The county seat is Burlington, Kentucky. The court house records begin in 1800 and contain a complete record of old wills, estates, inventories, guardianships and other miscellaneous estate items all bundled together in the same book. In other words, when you research these books, detailed account of the estate usually follows the last will and testament up until the time that it was settled.

It is not uncommon for a wife to be expecting a child at the time that her husband writes his last will and testament, or dies intestate. To learn if this was the fact, one should look for the legal language of "in esse" in the will. It means "in existence". Otherwise, a complete study of the probate records is indicated. If the person died intestate (without a will), then the letters of administration, annual returns, vouchers, receipts, sales, inventories, etc. should be closely examined for any activity which resembles the birth of another heir. This includes Inferior Court cases which might be on the books as well as Minutes of the Inferior Court. There are some census records which could help. Say, the husband died in 1841. The 1850 census should reveal the name of the widow and all of her children. Then there is the court for orphans where bonds are given and guardians are appointed. Old newspapers (announcing births and deaths), cemetery plots which contain infant graves, and so on, need to be carefully considered. One of the most interesting facets of researching in Virginia is that the wills, inventories, sales and deeds are contained in one book. This is the best source for learning little tid-bits of information which help to form the puzzle.

Land in Bracken County Land in Bracken County Bracken County was organized in 1796 from parts of Mason and Campbell Counties. Originally, the county extended to southern Nicholas County (north of the Ohio River and west of the Licking River). It has two creeks (named for William Bracken), the Big and Little Bracken. William Bracken was a surveyor by trade and visited the area in 1773. He was later killed by Indians during the Northwest Indian War. The first county seat was Augusta, Kentucky but was moved to Woodward Crossing (Brooksville).
